1. Acceptance of Terms

By accessing or using ‘Licensing Expert’ website, engaging our services, or submitting information via forms, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use immediately.


2. Services Provided

Licensing Expert provides consulting services including but not limited to:

  • Australian Credit Licence (ACL) applications and compliance
  • Australian Financial Services Licence (AFSL) applications and maintenance
  • Digital Currency Exchange (DCE) registration with AUSTRAC
  • Ongoing compliance and responsible manager (RM) services to ACL, AFSL Holders

We do not provide legal or financial product advice unless explicitly stated in writing by a licensed legal or financial adviser.


3. Client Responsibilities

Clients are responsible for:

  • Providing accurate and complete information
  • Responding to documentation requests within reasonable timeframes
  • Ensuring payment for services is made as per invoice terms
  • Ensuring they meet ASIC, AUSTRAC, or other regulator obligations post-submission

4. Fees and Payments

  • All fees are quoted in AUD and are inclusive or exclusive of GST, as stated.
  • Invoices must be paid within the terms noted on each invoice (typically 7 or 14 days).
  • Work may be paused or cancelled if payment is delayed or dishonoured.
  • Licensing Expert reserves the right to charge interest on overdue amounts and recover debt collection costs.

5. Refund Policy

Due to the bespoke nature of consulting and regulatory submission services, no refunds are offered once work has commenced, unless required by Australian Consumer Law. Where a refund is agreed to, any work completed to date will be deducted at the prevailing hourly rate.


6. Limitation of Liability

Licensing Expert and its representatives will not be liable for:

  • Delays caused by incomplete or inaccurate client information
  • Regulatory changes outside of our control
  • Any indirect or consequential losses
    Our liability is limited to the amount paid by you for the specific service engaged.

7. Confidentiality

We respect client confidentiality and take reasonable steps to protect your data. All client documents and communications are kept secure and only shared with your express consent, unless required by law.


8. Intellectual Property

All templates, documentation, advice, and materials provided remain the intellectual property of Licensing Expert and may not be redistributed, copied, or used for resale or publication without written permission.


9. Amendments to Terms

These Terms and Conditions may be updated at any time. We recommend reviewing them periodically. Continued use of our services or website implies acceptance of the current terms.


10. Governing Law

These terms are governed by the laws of New South Wales, Australia, and any disputes shall be handled in courts located in New South Wales.
